Terms of Service

These terms cover the Daymark subscription: one business location, one destination, one Daymark, with early access monthly or annual billing through Stripe.

Forecasts

Daymark presents modeled weather forecast data. It is not an official resort operations report, avalanche bulletin, ski patrol report, observed snowfall measurement, or safety advisory. Mountain conditions can change rapidly. Rely on the resort and the relevant safety authorities for operational and safety decisions.

The Daymark service

Daymark is a software service that helps a destination business turn a supported mountain destination and a live weather forecast into a branded guest Display, a daily print layout, and a social Story. V1 supports one user, one company, one destination, and one active Daymark per account.

Subscription and pricing

You can create an account, complete onboarding, and preview your Daymark without paying. Public Display, print output, and paid Story export without Daymark attribution require an active subscription.

Early access pricing is $39 USD per month or $399 USD per year, per business location, billed in advance through Stripe. The regular list price is $69 USD per month. Early access pricing applies for the first year of the subscription. After that year, the subscription renews at the regular list price. Historical subscribers remain on their existing Stripe Price and are not migrated automatically.

There is no free trial unless a trial is intentionally attached to the Stripe Price. Subscriptions begin when Stripe confirms payment, not when you return from Checkout.

Billing, cancellation, and resubscription

Stripe handles invoices, payment methods, and cancellation through the Billing Portal. You may cancel at any time. Access to paid outputs continues through the end of the paid period when cancellation is set to take effect at period end, then Display and Print are paused. You can resubscribe from Billing.

If a renewal payment fails, Daymark may keep Display and Print available for a short grace period while the payment is past due, then pause them if the subscription becomes unpaid or canceled.

Account access

You are responsible for the email address, password, and devices used to access the account. Notify Daymark if you believe the account has been used without permission.

Acceptable use

Use Daymark only for lawful business and guest-communication purposes. Do not attempt to probe, overload, or bypass the service; upload malware; infringe other people’s rights; or present Daymark forecasts as official mountain-safety information.

Intellectual property

Daymark and its templates, software, and documentation remain the property of Daymark. You retain rights in your company name, website, logos, destination or property photographs, and other brand assets you upload. You grant Daymark a limited licence to store and display those assets in order to operate the service for you.

Availability

We aim to keep Daymark available, but we do not guarantee uninterrupted service. Forecasts, authentication, email, payments, and hosting depend on third-party providers and can be delayed or unavailable.

Third-party services

Daymark uses Stripe for billing, Supabase for authentication, database, and file storage, Resend for transactional email, and Open-Meteo for weather forecasts. Their terms and privacy practices apply to the data they process.

Limitation of liability

To the fullest extent permitted by law, Daymark is provided as-is. Daymark is not liable for mountain travel decisions, guest injuries, lost revenue, or damages arising from forecast inaccuracy, service interruption, or third-party failures. Our aggregate liability for the service is limited to the amount you paid to Daymark in the three months before the claim.

These terms are between you and Daymark ("Daymark", "we", "us", or "our"), the operator of godaymark.com. Daymark is used here as a trading name and does not claim to be an incorporated company in this document.
